Yinon Eliya Levi, a 33-year-old individual, was charged on Thursday with reckless homicide concerning the death of Palestinian activist Awdah Hathaleen. The incident occurred during a confrontation in the village of Umm al-Khair, situated in the southern region of Hebron, last July.
Details of the Indictment
The indictment was presented by the Southern District Attorney’s Office in the Beersheba District Court. The charges against Levi included reckless homicide, as he allegedly fired his weapon near a group of villagers, which included children, after requesting an excavator to clear an unauthorized path across Palestinian-owned land. Additional charges included trespassing while armed and malicious damage to property.
The Victim’s Background
Awdah Hathaleen was not just an activist but also an English teacher dedicated to advocating against settler violence. He was a significant figure in his community, using his platform to shed light on their challenges. Hathaleen even contributed footage to the Academy Award-winning documentary *No Other Land*, which delved into the lives of Palestinians in the adjacent Masafer Yatta area.
Context of the Incident
Levi was employed as a contractor involved in developing a new settlement neighborhood in Carmel. His worksite bordered homes in Umm al-Khair and was outside the settlement fence. Allegedly, at the close of the workday, he instructed a 17-year-old excavator operator to clear a path not included in the original work plan and that intersected privately owned Palestinian land.
Local activists expressed concerns over Levi’s activities, claiming that his work posed a threat to Umm al-Khair’s infrastructure. Allegedly, he even attempted to damage the village’s primary water pipe. When residents of Umm al-Khair gathered to protest the excavation, they recorded the actions and tried to stop the excavator.
The Confrontation
Tensions escalated further when the excavator reportedly injured a protester with its breaker. The vehicle continued damaging crops and property after Levi signaled the driver to break down a second fence. A confrontation unfolded, during which stones were thrown by villagers in response to the actions of Levi and the excavator.
Levi is accused of then brandishing his firearm and firing a shot horizontally toward the village’s buildings, where both adults and children were present. Hathaleen was struck by a bullet while filming the events from about 20 meters away. He was taken to Soroka Medical Center in Beersheba but, unfortunately, arrived without any vital signs. The autopsy revealed that the bullet had pierced his lungs and a major blood vessel.
Following this tragic incident, Levi allegedly prepared to fire again, warning those present not to throw stones, before discharging a second shot into the air, further intensifying the volatile situation.
