Vice President Cevdet Yılmaz is set to lead the inaugural meeting of the “Board of Monitoring and Assessment” this coming Monday. This board is a key component of the newly enacted Law on Strengthening National Solidarity and Social Cohesion in Türkiye. The establishment of this law and board is regarded as a significant step in the ongoing movement for a “terror-free Türkiye,” which primarily targets the disarmament of the PKK, a group that has been entrenched in a violent struggle for decades. Following a series of initiatives, the PKK has reportedly agreed to disband by 2025, prompting members to surrender to authorities in light of the law introduced earlier this month. The implementation of this law hinges on the complete verification of the PKK’s disarmament, which is currently under governmental scrutiny.

Composition of the Monitoring and Assessment Board

The board led by Vice President Yılmaz comprises several key figures in the Turkish government. It includes ministers from the justice, foreign affairs, interior, and national defense sectors, along with the secretary-general of the presidency, the intelligence chief, and the secretary-general of the National Security Board (NSB). This diverse assembly underscores the importance of the initiative and its multi-faceted approach to achieving peace and stability in the region.

During the initial meeting, the focus will be on forming subsidiary boards that will tackle various aspects of this initiative. The first lower board will coordinate the surrender of PKK weapons and set up on-the-ground verification processes. With many PKK members believed to be hiding in northern Iraq, the board will determine the locations and timelines for the turning over of arms. Another important subsidiary board will oversee judicial proceedings for those PKK members who choose to voluntarily surrender. This body will receive legal input to classify each member’s legal circumstances and help them navigate the provisions of the new law.

Legal Framework and Provisions of the New Law

The newly enacted law comprises 12 articles, offering limited immunity from prosecution for PKK members who are not implicated in acts of terrorism or other serious crimes. The application of these exemptions will ultimately rest with judicial discretion. Additionally, a board dedicated to the social integration and rehabilitation of PKK members willing to return to Türkiye will be established. This board will benefit from input from experts in the Ministry of Family and Social Services and the Ministry of Health, thereby ensuring a comprehensive support system for those reintegrating into society.

The law also lays out provisions for the deferral of prosecution and the suspension of sentences for PKK members who apply within a designated six-month window following the PKK’s weapon surrender. This is contingent upon confirmation from the NSB that the PKK has fulfilled its disarmament obligations. Importantly, the law offers deferments for criminal investigations and proceedings related to PKK activities, with deferrals possible for 5 to 10 years, depending on the crime’s specifics.

Exclusions and Ongoing Political Context

Certain serious offenses, including intentional homicide linked to organizational activities, are explicitly excluded from the benefits of this new law. Notably, high-profile PKK leader Abdullah Öcalan will not be eligible for these provisions, nor will individuals guilty of serious crimes like intentional homicide. This exclusion is designed to ensure that while a path to reintegration is opened for some, public safety and justice are not compromised.

The “terror-free Türkiye” initiative is also expected to be a prominent topic during President Recep Tayyip Erdoğan’s upcoming visit to eastern Türkiye, coinciding with an anniversary commemorating a significant historical battle. As Erdoğan continues to address the nation alongside his ally Devlet Bahçeli of the Nationalist Movement Party, he reiterates the aim of fostering a sense of unity among Turks and Kurds. The overarching goal is to transform the PKK’s legacy from a separatist movement into a plan for peaceful coexistence in the region. This campaign, while ambitious, seeks to redefine the narrative surrounding the Kurdish struggle in Türkiye by emphasizing collective futures and shared heritage.
